BoatChecked, LLC – Terms and Conditions of Service

These Terms and Conditions (“Agreement” or “Terms”) constitute a legally binding agreement made between you (“Customer,” “you,” or “your”) and BoatChecked, LLC, a mobile marine service provider (“BoatChecked,” “Company,” “we,” “us,” or “our”), governing your access to and use of our boat inspection and cleaning services, including any service, website, mobile application, or booking interface offered by BoatChecked. By booking a service and affirmatively checking the acceptance box indicating that you “accept the terms and conditions,” you agree that you have read, understood, and consented to be legally bound by all of the terms set forth herein in their entirety, without modification or exception.

BoatChecked provides mobile marine services, including but not limited to visual and procedural inspections of marine vessels, routine cleaning and cosmetic services, engine start-ups and freshwater flushing procedures, and other related marine detailing tasks. All services are performed by trained personnel and are subject to change or substitution at the sole discretion of BoatChecked. You acknowledge and agree that BoatChecked is not engaged in mechanical diagnostics, mechanical repairs, or deep systems troubleshooting of any vessel, and that any representations to the contrary shall be null and void. Any advice or commentary provided by our staff is for courtesy purposes only and does not constitute professional mechanical advice.

By engaging our services, you understand and agree that all work performed is subject to inherent limitations, including but not limited to the pre-existing condition of your vessel, environmental factors at the service location, and restricted access or operability of onboard systems. You further acknowledge that BoatChecked shall not be held liable for any damage or deterioration to any part of your vessel, including but not limited to paint, gel coat, upholstery, electrical systems, mechanical systems, navigation equipment, or other physical or functional elements, whether latent or patent in nature. You explicitly release BoatChecked from any responsibility or obligation related to wear, tear, oxidation, aging, or general exposure-related damage that may manifest during or after the service. All services are delivered “as-is” and “as available,” with no express or implied warranties, and BoatChecked expressly disclaims any liability for incidental or consequential damages arising from or related to services rendered.

Payment for services is due immediately upon the completion of the booked service, as determined solely by the service provider. By submitting a booking request through our mobile application, website, or any affiliated scheduling portal, and by providing your payment information, you authorize BoatChecked to charge the applicable service fee(s) to the credit card, debit card, or other payment method on file without further notice or additional consent.

All charges are final, non-refundable, and not subject to dispute or chargeback. You agree not to attempt to circumvent this clause through financial institution disputes. If you experience a legitimate service issue, you must report it to BoatChecked before the service is marked complete; once marked complete, all associated charges are deemed accepted and undisputable. Subscription plans, including monthly or bi-monthly offerings, require a minimum commitment of two full-service appointments. You acknowledge that by subscribing, you agree to be charged for both services regardless of cancellation or interruption unless otherwise agreed in writing by an authorized BoatChecked representative. Cancellation of a subscription is not permitted until both required services have been rendered and paid in full.

By using our service, you warrant that you are the legal owner of the vessel or an authorized representative of the owner with full authority to approve service and assume financial responsibility for any charges incurred. You further agree to provide BoatChecked personnel with timely and unrestricted access to your vessel, including any necessary keys, access codes, marina permissions, or dock instructions. BoatChecked reserves the right to cancel, delay, or partially complete services due to inaccessibility, and you acknowledge that no discount or refund shall be provided under such circumstances.

You agree to indemnify, defend, and hold harmless BoatChecked, its officers, owners, employees, contractors, vendors, and affiliates from and against any and all claims, liabilities, damages, losses, judgments, penalties, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to: (i) your breach of these Terms; (ii) your vessel’s pre-existing condition; (iii) your failure to disclose known defects or operability issues; (iv) your failure to provide access or accurate service information; (v) any bodily injury or property damage caused by your vessel during or after service; and (vi) any third-party claims arising out of or related to the services provided. This indemnification obligation shall survive the termination or expiration of this Agreement and shall remain enforceable to the maximum extent permitted by law.

You hereby acknowledge and agree that you will not publish, disseminate, distribute, or otherwise share any false, misleading, disparaging, defamatory, or unsubstantiated comments or reviews regarding BoatChecked or its employees, affiliates, or services, whether through online review platforms, social media, forums, publications, email, or other communication channels. In the event of dissatisfaction with any aspect of the service, you agree to notify BoatChecked in writing and provide a reasonable opportunity to resolve the matter prior to making any public or third-party statements. Violation of this clause may result in civil action for defamation, libel, tortious interference, or breach of contract, and BoatChecked reserves all legal rights and remedies available at law or in equity.

You understand and agree that BoatChecked shall not be liable for any failure or delay in service delivery due to conditions beyond its reasonable control, including but not limited to weather events, labor shortages, equipment failure, internet or platform disruptions, or force majeure events of any kind. In such cases, BoatChecked may cancel or reschedule the appointment without liability, and you waive any claims for loss or inconvenience arising therefrom.

To the fullest extent permitted by law, the total liability of BoatChecked for any claim related to services rendered shall be strictly limited to the amount actually paid by you for the specific service giving rise to the claim. In no event shall BoatChecked be liable for indirect, incidental, special, exemplary, punitive, or consequential damages of any kind.

You further consent to the limited collection and use of your personal information, including your name, contact details, vessel information, and service history, for the purpose of delivering, tracking, and improving services. Your information will not be sold or shared outside BoatChecked without your consent, except as required by law or to process payments securely through trusted third-party vendors.

This Agreement is governed by and construed in accordance with the laws of the State of Florida, without regard to its conflicts of law principles. Any dispute, controversy, or claim arising out of or relating to this Agreement or your use of BoatChecked’s services shall be submitted to final and binding arbitration in the county where BoatChecked maintains its principal place of business. The arbitration shall be conducted under the rules of the American Arbitration Association, and judgment on the award may be entered in any court of competent jurisdiction. You waive your right to bring any claim in a court of law and agree to resolve all disputes through binding arbitration on an individual basis.

BoatChecked reserves the right to update, amend, modify, or otherwise change these Terms at any time without prior notice. Updated versions will be posted on the BoatChecked website and/or application interface and shall be effective immediately upon publication. Continued use of the services constitutes acceptance of any updated Terms. You are encouraged to review the Terms periodically.

These Terms constitute the entire agreement between you and BoatChecked regarding the services provided and supersede all prior or contemporaneous communications, agreements, or understandings, whether oral or written. If any provision of these Terms is held to be invalid, unlawful, or unenforceable for any reason, the remaining provisions shall continue in full force and effect.
